ADA Compliance & Regulations

ATM owners across the country, including thousands of merchants large and small, must make their ATMs compliant with new federal Americans with Disabilities Act (ADA) regulations. In many cases, the new regulations will require that older ATMs be upgraded or replaced.

What You Need To Know

    • ADA compliance is mandatory
    • all ATMs must comply by March 15, 2012
    • Many ATMs are not prepared for voice guidance today and will require upgrades or replacements
    • ATM owners, including merchants who own their ATMs, are each responsible for achieving ADA compliance across their ATM fleets, whether they own one ATM or thousands
    • ADA compliance extends beyond voice guidance requirements with regulations impacting numeric PIN pad design, function key visibility, transaction screen readability, Braille requirements and physical ATM accessibility

The U.S. Department of Justice recently issued revised ADA regulations, including changes to its 2010 Standards for Accessible Design that effect ATMs. Details on how the regulations affect ATMs can be found in section 707, Automatic Teller Machines and Fare Machines.

The final regulations, including the 2010 Standards for Accessible Design, went into effect on March 15, 2011 for new ATMs deployed in the United States. However, under a “safe harbor” clause, compliance is not required for new construction and alterations to existing ATMs until March 15, 2012 if implementing the upgrades would result in “an undue financial burden.” There will be no “safe harbor” for communications elements. ATM owners (financial institutions, ATM ISOs and ATM operators) MUST have a detailed compliance plan in place by March 15, 2011.
